Special Education Law – Overview

Many of us, who went to school not that long ago, remember that being a special needs student meant riding to school in a separate bus and attending one class with other children of varying disabilities. These classes resembled more of a day care than school, and even the most advanced students had little hope of receiving a high school diploma, let alone attend college. Since that time, the term disability, and special needs student, has expanded to encompass much more than a person with an IQ below a certain arbitrary standard. What I have attempted to do in my first article is to give a little history of the evolution of the Individuals with Disabilities Education Act.

In 1954 the United States Supreme Court decided Brown v. Board of Education, 347 U.S. 483 (1954) which found that segregated schools were a violation of equal protection rights. It would be another twenty years before this concept was applied to children with handicaps, especially learning disabilities, trying to receive an education. In fact, shortly after Brown was decided the Illinois Supreme Court found that compulsory education did not apply to mentally impaired students, and as late as 1969, it was a crime to try to enroll a handicapped child in a public school if that child had ever been excluded.

Due to court challenges in Pennsylvania and the District of Columbia in the early 1970′s things started to change. In 1975 Congress enacted the Education for All Handicapped Children Act of 1975. This was the first law that mandated that all handicapped students had a right to an education. Not only did it mandate that all handicapped students had a right to an education, it also mandated that local educational agencies could be held accountable for not doing so. Shortly thereafter, the term handicapped was replaced with “child with a disability”. Although revised in 1990 as the Individuals with Disabilities Education Act (IDEA), the most comprehensive changes came in 1997. This law required schools to identify children with disabilities to make sure that all children have available a “free appropriate public education and related services designed to meet their unique needs and prepare them for employment and independent living” 20 U.S.C. ยง 1401 (d). Unfortunately, the most recent changes in 2004 made the law slightly more difficult to receive the benefits they deserve, which, depending upon the next administration and the make up of Congress may or may not be a trend that will be followed in the future.

Exactly what is a “free appropriate public education”? Under the law, it is defined as “special education and related services that (A) have been provided at public expense, under public supervision and direction, and without charge: (B) meet the standards of the State educational agency; (C) include an appropriate preschool, elementary or secondary school education in the State involved; and (D) are provided in conformity with the individualized education program required under [the law].” In other words, the school must provide services that meet the needs of a child with a disability that may affect their ability to learn. These “related services” can be services that are provided in the classroom, such as giving the child extra time to finish taking tests. They can also encompass services that can be provided outside of the classroom, such as tutoring, or having the child attend either a day or residential program outside of the school, along with transportation.

Fifty Years of Technology Gone?

Technology has come a long way in the past fifty years. So if I told you something about all the great technology in the past fifty years I could go on forever!

But instead lets just focus on some of the great technology we’ve enjoyed for the past fifty years, but has unfortunately disappeared much too soon due to the replacement of even newer technology.

Let’s begin back around the late 1960′s, and into the 1970′s with the development of the simple 8 track cassette which was the new technology for listening to music at the time. In order to listen to the 8 Track Cassette you just had to have an 8 Track Player, and if you did you were all set to enjoy some music.

Now personally I’m old enough to have been around during that great period of time to have seen the success, and the fall of the 8 Track player. Can you believe that I actually still have some of my old 8 Tracks from back at that time, but I’m not able to play them due to no longer having an 8 Track Player to actually play them on.

But besides 8 Tracks there were also the 4 Track Cassettes which at the time was actually developed just prior to the 8 Track, but had a short life primarily because it had only two tracks, meaning that when you actually wanted to listen to a different song you would have to push a button on the player to change the track. But with the 8 Track you actually had four tracks which gave you a better selection of songs to choose from which was much more popular with people who bought them.

As time proceeded much smaller Cassettes were on the market also for listening to music, but these cassettes were much more compact than the 8 Track Cassettes were. So now we had both the 8 Track Cassettes as well as the compact smaller Cassettes to enjoy listening to music, but as time continued on before you could say “8 Track Cassettes” they we’re gone! Leaving us with only the smaller Cassettes to listen to and to enjoy.

So the only other format to listen to music at that time was the standard Photograph Record Player which of course had been around for many years. But as time passed by once again soon the Cassettes were no longer available as well. So now you would no longer have to worry about tapes breaking, or coming out of the cartridges with either the 8 Tracks, or the Cassettes alike, so now both Cassettes are gone. While we still had the Photograph Record Player to enjoy listening to music however it may just be until the next big technology came along, and so just what and when would that be?

So that next big technology that allowed us to listen to music that sounded better than ever was the Compact Disc (CD), and this format was no longer a tape, but a disc. I personally can still remember the time when the local record store took all of the photograph records off their selves, and replaced them all with Compact Disc’s (CD) that was impressive for me because that was a major change from the Records that I grew up with, and had enjoyed playing for years, but were no longer available at what was one time called the “record store” as it had all changed now to the CD’s.

Now for changing the players from the standard Record Player to the CD Player, and to enjoy listening to music was probably one of the biggest changes ever for the listening of music. This technology change from records to CD’s was a much better sound which eliminated the “pops” that records typically would have. So today we still have CD’s available, but with all the other means that people have to enjoy music on the internet, and elsewhere the CD’s are just not as popular as in the past, and perhaps the day may just not be too far off before it also becomes difficult to find them as well.

Now what about the technology that brought us the Video Cassette Recorder (VCR)? Well first with the Video Cassette Recorder basically there were two different types of tapes that were available to use on your VCR. First there was the Beta Cassette, and latter there was the VHS Cassette. You can still purchase the VHS Cassette even though it may be very difficult to do so, but as for the Beta you can no longer find it due to the simple fact that the Beta Cassette was much smaller than the VHS Cassette was, and so as a result less storage space to record was available.

The Video Cassette Recorder (VCR) was nice because you could record your favorite TV Show at any time, and then play it back to watch it at your convenience anytime you choose to do so. I personally recorded, and purchased many different Cassette’s that soon had grown into a large Video Cassette Library that I still in fact have. But are you aware that Beta, and VHS were both tapes as were the 8 Tracks, and the small Cassettes, and now that’s all old technology, and you may recall what happened to them. YES… they were replaced with the new technology just as the Video Cassette Recorder was.

Now what new technology was going to be next? What great technology replaced the Video Cassette Recorder? The answer is the DVD Player! and it is still a current technology enjoyed today, but again has no tape because its simply a disc. Does this sound familiar? Of course the 8 Track Tape technology which changed to CD’s, and now with Video Tapes on the VCR changing the technology to DVD’s.

So when you set down to enjoy music as well as watching movies all this technology may only be the beginning. And to fairly discuss all technology advances would require something short of writing a book. So I have focused only on the technology in which I have discussed in part due to it actually being a big part of my life as I grew up. So no matter if you personally experienced this technology or not I sincerely hope that you will find it all as fascinating as I did, and you will follow the continuous changes of technology as it is related to music, and movie entertainment.

So now we can only wait for the next great technology change that gives us something we’ve never experienced before, in the mean time continue to follow the forever changes in technology.

Social Media Marketing Works – Just Not the Way You Imagine It Should

Recently, a business owner called my office, sharing his concern that articles posted to the business Facebook page weren’t about his business specifically, and that he didn’t see the value in social media because it didn’t seem like it was being done “right.” While there is still no one way to make social media marketing work for everyone, there are ways to better establish an online presence and personality that will only help your business grow its brand online and offline. Let’s review some of the facts in this particular case:

The business owner said customers asked about the articles posted on Facebook

Conversations being started at your place of business because of social media gives you a chance to chat it up with your customer and get to know them even better so you can offer even more customized service. In this case, people were curious about some of the articles posted (usually related in some remote capacity, but often about local news or other interesting events trending online), and the business owner simply didn’t know how to respond. Social is about being social, and it does often extend into the business space, so staying aware of your social campaign will definitely help you engage customers on a more personal level. Be prepared to get social in the real world!

Many business owners simply do not understand the purpose of social media, because it is often times still new to the individuals working at the business. This particular case was unusual because contact was a consistent challenge throughout the months of the campaign’s run. From a social media marketer to business owners everywhere, my best piece of advice is this: Before you go social online, make sure you understand how it will work, establish goals, and educate yourself on the products and services you’ll be paying for. This gives you an understanding of how the social media marketer will be operating and gives you confidence in how you respond to the service results. Everyone should know what they’re spending their business dollars on! It’s your hard earned money, after all.

Leads were generated

The most important part of this particular case was that leads were, indeed, generated from the social media. Six were counted over a period of a couple months! If the company had actively pursued those leads, which were relayed to salespeople at the business via email and telephone contact, those leads would have paid for their social media for a year, and left them with a pretty profit, to boot. In short, their social media performed, and the business owners did not understand it or have enough interest in it to see the value of social media, even when it was becoming quite clear.

The moral of this story? When social is not taken seriously by the business owner, opportunities will be missed, and the connection with customers will weaken over time. This comes down to involvement and communication. A business owner who makes contact challenging will miss out on leads whether they go social or not. Simply put, availability generates sales. If you make yourself hard to contact, your potential client will go to the place that IS available. Social is an extension of your availability as a brand. By going social and extending additional outlets for customers to reach you with, you give your business an upper-hand in communication and customer relationship building.

Is There Still A Shortage of Special Education Teachers?

Today, I am a Special Education teacher. However, I can still remember when I was young and back in graduate school matriculated in the social studies teaching program. Since I wanted to be a History teacher, not a Special Education teacher, it’s kind of funny that all these years later I am teaching Special Education. How did this happen? Well, the same way it happened for some others too I guess… I had friends who were Special Education teachers and also a few who were enrolled in Special Education teacher-preparation programs who talked me into giving it a try. They told me that Special Education is where the real need was. Basically, they told me that this is where a guy like me could do the most good.

Well, more than two decades later not much has changed. There is still a huge need for Special Education teachers here in the United States. According to the U.S. Department of Education, Special Education is among the most high-need fields in schools that service low-income students. The U.S. Department of Education also states that there is a Special Education teacher shortage in 49 out of our 50 states.

In addition, today there are more instances of students with multiple disabilities at a younger age. The National Education Association (NEA) says that there has been a 30% increase in Special Education students since 2006. Finally, throw in the high turn-over rate of teachers in such a demanding field and one can easily see that our country has a problem, and that problem is only going to get bigger.

So, why can’t we get enough Special Education teachers? Well, according to National Public Radio (NPR) our country is having this shortage because of the extremely long hours they have to put in and the crushing paperwork that they are expected to complete on top of their everyday teaching. I say we’re also having this shortage because being a Special Education teacher isn’t for everyone. Only a few people can handle the day-in and day-out uncertainties of the job, and the ever-changing roles they have to play. Not only do they have to take an enormous amount of time to learn the academic side of multiple subjects or scholarly disciplines, which could take five to ten years to fully learn, but they also have to learn about all the different factors that could impact academic performance, and learn the law too, as well as do many administration duties.

In a word, it’s overwhelming. Just considering the disabilities side alone, a Special Education teacher has to be able to accurately identify and treat needs that could be based on learning deficiencies or even different styles, as well as the mental, emotional, and even social deficiencies too. Furthermore, Special Education teachers also have to know what to do with the other side of the spectrum too with the gifted students.

Basically, not only do they need immense people skills in dealing with all kinds of students and adults, but they also have to love the unpredictability of the field, and must be a believer in possibilities, as well as possess the highest form of intelligence, which is called empathy. Not sympathy here, but empathy. There is a difference between empathy and sympathy. Special Education teachers need all of these mentioned skills and more in order to just survive the day, let alone an entire career in these education trenches.

So, what can we do about this shortage? Well, some school districts have been creatively working with their local universities and creating special programs where teacher candidates can work full-time as teachers for two years to get teaching experience while they go to school at night to get their degree. Some school districts have offered signing bonuses, stipends and tuition reimbursement in their efforts to attract more teachers. These are good ideas. However, these kind of initiatives are not being done enough. Some school districts are offering young teachers mentors to support their efforts and offer guidance in an attempt to cut down on the attrition rate. Again, this is another good idea, but not enough districts are doing this either.

I personally feel that one of the toughest things about being in this field is the lack of respect for what these unsung heroes do on a daily basis. The lack of respect is causing low teacher morale and driving a lot more teachers out of the education field than I think most of us are willing to admit. And this low teacher morale and lack of respect for our country’s teachers is something that is avoidable, and something that we can fix if we want to do it bad enough. Finally, just to get an outsider’s perspective, I asked my wife what she thought could be one of the solutions to the Special Education teacher shortage problem and she said, “More pay!”

The Future of Ethics and Morals

In his essay “Perpetual Peace,” the German philosopher Immanuel Kant talked about the importance for each country to come together and join forces in a “league of nations” whose sole objective would be to ensure their peaceful coexistence. According to Kant, the governments are morally obligated to pursue peace and collaborate with other nations to ensure perpetual order.

Kant’s ideal and the need for a set of rules to govern our self-interested behaviors are now more evident than ever before. In today’s America, there is a rupture between those who still live by the principles of ethics and morals and those who don’t care for them at all. Instead of being united by the ideal of peace, as Kant envisioned the future, we are divided by hatred.

Given these circumstances, one can’t help but wonder: what is the future of ethics and morals in today’s America?

The Importance of Ethics

No nation can survive without a strong ethics and moral foundation. They’re the driving force that shapes individual behaviors within a society. While the written law holds people and companies responsible for their actions, ethics represent a self-governing system that allows people to live together and preserve the peace of the community. Due to ethics, we’ve achieved a state of equilibrium that teaches us how to behave when the watchful eye of the law is not available.

However, in today’s society, ethics seem to have eroded. More often than not, people no longer respect the unwritten rules that ensured their peaceful coexistence. And, the deeper the erosion of ethics, the more the interaction between people, whether it’s business or friendship, suffers. Since fewer people respect the rules, nobody will no longer trust anybody and society as we know it will cease to exist.

Are Ethics and Morals in America an Endangered Species?

It might seem like a grim picture but, judging by the way things are going right now, ethics and morals look like an endangered species. One of the most visible signs that we have a serious ethics problem is within the life and blood of our country: the Government.

The Government is the part of America where the deterioration of ethics and morals can best be observed. It’s here that greed, personal interest, and corruption have taken over the rigorous standards and behaviors that once prevailed.

Ethics and morals are on the verge of becoming extinct in today’s Government. Instead of addressing and solving some of the country’s most stringent problems, such as the deterioration of the education system, income inequality, massive student debts, and so on, politicians parade them in front of the citizens, inciting them one against each other.

As a result, we are deeply divided on every possible subject from abortion and marriage to guns, foreign policies, migrants, privacy right, and even God.

Fortunately, there’s one thing we can all agree: the country is going in the wrong direction.

A Ray of Hope

Evidence of America’s crisis of ethics can be seen everywhere, from the business world to our politics. However, our personal and social behavior has improved significantly in the past few decades. Although it may not seem like it, we are less racist, homophobic, and sexists than we were three decades ago. The rates of crime, drunken driving deaths, divorce, teen pregnancy, and domestic violence are also down.

Why this gap?

One explanation might be that while we are divided regarding important national issues, we’ve understood that if we want to live in a peaceful community, we need to keep our conduct in check. We’ve understood that united we can work and function better. Now, we need to apply this as a nation as well.

Let’s not allow the elite to divide us. United we are better and stronger!
